我国环境刑罚轻缓化探析

毋庸置疑,在整个国际社会对环境犯罪处以轻缓刑罚的背景下,我国亦应该对环境刑罚采用轻缓化的原则。诚然,我国的环境刑罚制度与其他国家相比还有许多亟待完善的地方,但这并不妨碍我们在借鉴其他国家先进的立法经验的基础上构建适合我国具体国情的环境刑罚制度。在环境刑罚中要突出自由刑的适用,扩大并完善财产刑的适用,明确财产刑中过于模糊的规定,逐步改善环境犯罪的刑事处罚措施过于单一的缺点和功能上的不足,同时提高对辅助刑罚措施的关注。在环境犯罪方面,在适用传统刑罚措施惩治的基础上配合适用辅助刑罚措施,使我国环境刑罚轻缓化实践不至于成为一纸空谈。     

城市经济圈发展助推区域一体化——兼论南沙新区与港澳的经济合作

根据区域一体化理论,结合新时期广东省在推进珠三角一体化中,建立和发展广佛肇、深莞惠和珠中江三个经济圈的实践,分析了区域经济一体化对区域整体发展的新意义、地位和作用,讨论了珠江三角洲通过建设和发展若干个以经济发展为核心的现代都市圈,对于新时期加强与港澳经济合作,促进区域经济一体化的更好发展颇具深远的意义和作用。     

空间外溢与区域经济增长趋同——基于长江三角洲的案例分析

空间俱乐部趋同是指经济增长初始条件和结构特征相似且空间上相邻的一组区域的经济增长收敛于相同的稳态,是区域经济增长俱乐部趋同的一个新研究领域,其发生机制是空间外溢促成区域经济出现地方化增长,进而导致空间俱乐部趋同。运用包含空间外溢的区域经济增长理论模型可以证明,空间外溢有可能导致空间俱乐部趋同。对中国长江三角洲1990—2007年区域经济增长过程所做的经验分析也表明,空间外溢对区域经济增长确有影响,空间俱乐部趋同客观存在。在考虑空间外溢的情况下,长江三角洲的空间俱乐部趋同速度为1.57%。

闺阁、青楼场域差异影响下的文学传播与接受——以明代女性词人为例

摘要:闺阁与青楼本身是两个截然不同的场域,其中的行动者自有差别.闺阁、青楼场域的资本积累模式影响了其中女性的文学传播接受活动.启蒙教育、场域文化积累、文学传播情况均使闺阁女性有更多接受文学的机会,同时也承担更多的文学传播义务.而青楼女性的文学接受滞阻更为严重,且对场域的文学传播不发生太大作用.闺阁、青楼女性有相似的文学传播观念,她们较前代女性都有积极传播的意识.但青楼女性更多是为积累文化资本以为稻粱谋,闺阁场域的文学传播观念则相对纯粹.     

Confidence Corridors for Multivariate Generalized Quantile Regression

We focus on the construction of confidence corridors for multivariate nonparametric generalized quantile regression functions. This construction is based on asymptotic results for the maximal deviation between a suitable nonparametric estimator and the true function of interest, which follow after a series of approximation steps including a Bahadur representation, a new strong approximation theorem, and exponential tail inequalities for Gaussian random fields. As a byproduct we also obtain multivariate confidence corridors for the regression function in the classical mean regression. To deal with the problem of slowly decreasing error in coverage probability of the asymptotic confidence corridors, which results in meager coverage for small sample sizes, a simple bootstrap procedure is designed based on the leading term of the Bahadur representation. The finite-sample properties of both procedures are investigated by means of a simulation study and it is demonstrated that the bootstrap procedure considerably outperforms the asymptotic bands in terms of coverage accuracy. Finally, the bootstrap confidence corridors are used to study the efficacy of the National Supported Work Demonstration, which is a randomized employment enhancement program launched in the 1970s. Optimal financing and dividend policy with Markovian switching regimes

This work investigates an optimal financing and dividend problem for an insurer whose surplus process is modulated by an observable continuous-time and finite-state Markov chain. We assume that the insurer should never go bankrupt by issuing new equity. The goal of the insurer is to maximize the expected present value of the dividends payout minus the discounted cost of equity issuance. We obtain the optimal policies and explicit expressions for the value functions when the risk reserve process is modeled by both upward jump model and its diffusion approximation. Numerical illustrations of the sensitivities of the model parameters are provided.     

适度提高养老保险农民缴费档次的可行性分析

通过对不同经济发展程度地区农民参保情况的调查,发现目前农民在选择养老保险缴费时往往选择最低标准和档次的缴费。通过分析,认为城乡居民基本养老保险制度设计缺乏长远考虑、制度执行过程注重眼前利益、农民更倾向传统养老方式以及存在盲从心理等是城乡居民基本养老保险农民低档次缴费的原因。在对农民养老需求与缴费能力进行分析的基础上,认为当前可以适度提高农民缴费档次,通过采取更具有激励性的缴费政策、规范制度执行等措施来促进农民选择更高的缴费档次。     

‘Nothing about us without us’: the emerging disability movement and advocacy in China

The disability movement and disabled persons’ self-help organizations (DPOs) are emerging in China, some of which succeeded in promoting policy and social changes with special strategies. Based on an original survey and interview, this article explains the development and survival strategies of China’s DPOs, and especially interprets some successful cases of social advocacy and policy advocacy in the emerging disability movement. It is hoped that scholars will pay more attention to the advocacy and public engagement of the disability community in non-western settings in the future.
